Rules of the 2007 Board Rules and Findings
It is the decision of the 2007 OHHA Board of Directors (Board)
that we need to draft, maintain and publish a set of both rules
and findings. The rules, beyond that specified in the bylaws,
will place a structure under which the Board will conduct business
during the year. In addition, certain items have been investigated
by the 2007 OHHA Board and our findings are list herein. These
will be always listed at the website.
Findings
- We find, based on historical precedent and our reading of
the By-Laws, that dues on the General Membership are voluntary
under the current By-Laws.
- We find, based on our reading of the Covenant, that membership
in the OHHA is voluntary on the homeowners of the Orchard Hills
subdivision. Currently, all Homeowners in the Orchard Hills subdivision
are members of the OHHA
- We find that a current Household may resign from the OHHA
by signed, dated request by all General Members who are owners
of said Household.
- We find that a Household may re-enter the OHHA by signed,
dated request by all General Members who are owners of said Household.
- We find that General Members, per the By-Laws, cannot vote
until they have paid the dues for all the years they have been
Homeowners in the Orchard Hills subdivision, inclusive of such
programs as Adopt-an-Island.
- We find that although the By-Laws use both terms "Lot
Owner" and "Home Owner" that both terms are held
to mean "Lot Owner" and we will use the term Homeowner
to mean both in our communications.
- We find that the Board must only execute contracts with an
explicit term and said term must be one year or less, as per
our By-Laws.
- We find, based on our reading of the Covenant, that the OHHA
has no standing to enforce the standards of the Covenant
Rules
- We will not litigate against any General Member.
- We will not place liens against any General Member.
- The board will speak with one voice. All communications to
the OHHA General Membership will come from the Secretary. All
other Board members will not make statements on board policy/issues.
- We will publish minutes of all board
meetings and General Membership meetings on our website.
- We will publish any contract entered
into by the OHHA on the website.
- All non-contract expenditures will be presented to the President
for his sign off, and then sent for payment by the Treasurer.
Therefore all payments will be authorized by at least 2 officers.
- We will publish a OHHA Newsletter at least once per quarter,
in the first month of the quarter if possible.
- We will publish any changes to these rules by email and on
the OHHA website, www.ohha.us
